One More Thing Governor Ron DeSantis Could Do to Help the Florida Hurricane Restoration Process

Get the condo Nazis and the HOA boards and their
committees out of the restoration business

As the latest and perhaps largest hurricane disaster ever in Florida begins to unfold, one can only imagine that the condo associations, homeowners’ associations, and their fleet of legal firms dedicated to the practice of HOA/condo law are salivating at the opportunity to get their fingers into every facet of the rebuild and reconstruction of the homes and condominiums under their control.

Your homeowners association or condo association is authorized under the 2022 Florida Statutes in Title 40, Chapter 720, entitled Homeowners Associations.

If you've never looked at this particular statute, I would offer that now is a very good time to go online and look it up.

In addition, you may want to rummage around in your documents related to the purchase of your home or condominium and see if you can find a copy of the most-recent homeowners association charter along with the declarations.

These documents, depending on how they were drafted, may have significant requirements that you must meet as part of any renovation, rebuilding or repair on your condominium unit or your private home.

Governor DeSantis should immediately by executive order provide homeowners in the declared disaster areas' complete and total relief from Florida chapter 720 and any, and all homeowner’s association requirements and declarations issued under the statute.

The last thing that people within the disaster areas that live in controlled communities need at this point is yet another level of somewhat insane bureaucracy providing input to their insurance company and their contractors regarding how restoration and renovations may be conducted.

The requirement that the Architectural Committee, a common feature in many homeowners and condo association declarations, has the right of approval over all changes, modifications and improvements to your property must be suspended immediately.

Unless appropriate steps are taken, it is highly likely that following renovations to your condo or your private home in a HOA controlled community, you may be the victim of harassment and fines by the condo association/HOA supported by their management company.

A GOOGLE search for Homeowners association lawyers in Florida produced 4,380 results.

There's already enough stress involved in this disaster and its ongoing recovery.

Allowing condo associations and HOAs the legal right to meddle in the decisions that need to be made quickly and implemented as soon as possible is a recipe for disaster.
